I irrevocably grant to San Diego Gas & Electric Company and its affiliates (collectively, “Company”) the perpetual right to utilize, in its sole discretion and without any obligation of further approval or compensation in any form my image (still and moving), name, likeness, voice, statements (oral and written), and other information or materials describing or portraying me, as recorded by Company or provided by me to Company, including (as applicable) reference to me as a satisfied customer or employee of Company, as a participant in the Company event specified at the bottom of this form to which this online registration relates, or as a satisfied user of Company’s products or services generally (collectively, “Images”).

The utilization rights of the Images granted in this release include: (i) all future rights of use by Company and its advertising representatives at any time hereafter; (ii) the right to use the Images in any form of media (now known or hereafter developed), including print, video, motion picture, still photographs, sound recordings, and Internet postings and other electronic formats (“Media”); (iii) the right to use the Images in advertising, training, publicity, promotional, and other uses regarding Company and its activities; (iv) the right to edit, alter, copy, exhibit, publish and distribute the Images for any lawful purpose; (v) the right to license or sublicense through multiple tiers all or any portion of the Images to any third party; and (vi) the right to combine Media relating to me with materials related to other individuals, properties, or entities, including customers or employees of Company. I understand and agree that the Images and all materials utilizing the Images will become the property of Company and will not be returned, and I waive any right that I may have to inspect or approve the use of the Images or any reproductions thereof.

I agree to hold harmless and release Company, its contractors and employees, and any third parties involved with the use of the Images from all claims that I, my heirs, executors, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this release, including any claims for invasion of privacy, right of publicity, misappropriation or misuse of image, or defamation.

BY SIGNING BELOW, I AFFIRM THAT (i) I HAVE READ, UNDERSTAND, AND AGREE TO THE TERMS OF THIS COMPREHENSIVE USE RIGHTS AND RELEASE, WHICH ARE LEGALLY BINDING AND EFFECTIVE AS OF THE DATE OF MY SIGNATURE, AND (ii) I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENT/GUARDIAN AS EVIDENCED BY HIS OR HER SIGNATURES BELOW.
